Consumer Rights
"The consumer is KING. But only if the king KNOWS his rights. An informed consumer is a PROTECTED consumer."
1. Who is a Consumer?
A consumer is ANY person who BUYS goods or uses services for PERSONAL use (NOT for resale or commercial production).
'You are a consumer EVERY time you buy a biscuit, take a bus, visit a doctor, or recharge your phone. The LAW protects you in EVERY such transaction.'
2. The Consumer Movement in India
| Milestone | Year | Significance |
|---|---|---|
| First consumer group formed | 1960s | Voluntary organisations began FIGHTING unfair trade practices. |
| Consumer Guidance Society of India (CGSI) | 1966 | Mumbai — first FORMAL consumer organisation. |
| Consumer Protection Act (COPRA) | 1986 | LANDMARK law — gave consumers LEGAL rights. Created consumer courts. |
| COPRA amended | 2019 | UPDATED for digital age — e-commerce, OTT, online purchases included. |
| National Consumer Day | December 24 | Celebrated on the day COPRA received Presidential assent (1986). |
3. Consumer Protection Act, 2019 (COPRA 2019)
COPRA 2019 REPLACED the 1986 Act. Key changes:
| Old (1986) | New (2019) |
|---|---|
| No specific e-commerce provisions | E-commerce INCLUDED — Amazon, Flipkart covered |
| Pecuniary limits: DCDRF up to ₹20L, SCRF up to ₹1Cr, NCDRF above ₹1Cr | NEW limits: DCDRF up to ₹50L, SCRF ₹50L–₹2Cr, NCDRF above ₹2Cr |

| Product liability NOT clearly defined | PRODUCT LIABILITY — manufacturer/service provider LIABLE for defective goods/harmful services |
| No provision for MISLEADING ads against celebrities | CELEBRITIES can be PENALISED for endorsing misleading ads |
4. Rights of Consumers
COPRA defines SIX fundamental consumer rights:
| Right | Meaning | Example |
|---|---|---|
| 1. Right to SAFETY | Protection from DANGEROUS goods and services | Expiry date on medicines. Electrical appliances with ISI mark. |
| 2. Right to be INFORMED | Know PRICE, quantity, ingredients, expiry date, manufacturer details | MRP is MANDATORY. Ingredients listed on packaged foods. |
| 3. Right to CHOOSE | Access to VARIETY at COMPETITIVE prices | Multiple brands of soap, oil, detergent — monopoly is BANNED. |
| 4. Right to be HEARD | Consumer interest REPRESENTED in policy-making | Consumer groups in government committees. Grievance redressal. |
| 5. Right to SEEK REDRESSAL | Get FAIR settlement of complaints | Consumer courts. Compensation for DEFECTIVE goods. |
| 6. Right to CONSUMER EDUCATION | Learn about rights and RESPONSIBILITIES | Awareness campaigns, school curriculum, media programmes. |
4.1 Additional Rights Under COPRA 2019
| Right | Explanation |
|---|---|
| Right to file complaint where consumer LIVES | Previously had to go to seller's location. Now file LOCALLY. |
| Right to product liability claim | If a product causes HARM (injury, death, property damage), manufacturer/provider is LIABLE. |
| Right against UNFAIR contracts | Courts can VOID contracts that are ONE-SIDED and UNREASONABLE. |
5. Consumer Courts — Three-Tier Redressal System
| Court | Level | Claim Amount | Appeal To |
|---|---|---|---|
| District Consumer Disputes Redressal Forum (DCDRF) | District | Up to ₹50 lakh | State Commission |
| State Consumer Disputes Redressal Commission (SCDRC) | State | ₹50 lakh – ₹2 crore | National Commission |
| National Consumer Disputes Redressal Commission (NCDRC) | National | Above ₹2 crore | Supreme Court of India |
5.1 How to File a Complaint
- Keep PROOF: Bill/receipt, warranty card, product photos, advertisement (if false claim).
- Write a NOTICE to the seller/manufacturer — give them 30 days to RESPOND.
- If NO response → file case in the APPROPRIATE consumer court.
- Filing fee: Very LOW (₹25–₹50 for claims under ₹1 lakh). Affordable.
- NO lawyer needed — consumer can argue the case PERSONALLY (though lawyer helps).
- Time limit: Complaint must be filed within 2 YEARS of the cause of action.
Common Mistake: Many think you need a lawyer to go to consumer court. You DON'T. Consumer courts are designed to be 'PEOPLE-FRIENDLY' — no legal expertise REQUIRED.
6. Quality Marks (ISO Standardisation)
| Mark | Meaning | For |
|---|---|---|
| ISI (Indian Standards Institute — now BIS) | Product meets INDIAN safety and quality standards | Electrical appliances, LPG cylinders, food mixers, switches, cement |
| Agmark | Agricultural products GRADED for quality | Pulses, grains, spices, oilseeds, fruits, vegetables |
| Hallmark (BIS) | Purity of GOLD and SILVER jewellery | 916 (22K), 750 (18K), 585 (14K) for gold. 925 for silver. |
| FSSAI | Food safety — APPROVED by Food Safety and Standards Authority | ALL packaged food items must have FSSAI logo |
| Eco-mark | Environment-friendly product | BIS-certified eco-friendly products |
| Woolmark | PURE wool | Woolmark symbol = 100% new wool |
Important: ISI and Agmark are VOLUNTARY for some products, but MANDATORY for 125+ products (including helmets, LPG cylinders, cement). FSSAI is MANDATORY for ALL packaged food.
7. Responsibilities of Consumers
Rights come with RESPONSIBILITIES:
| Responsibility | Why It Matters |
|---|---|
| Check quality marks (ISI, Agmark, Hallmark) | Ensures you get SAFE, quality products. |
| Ask for a BILL / receipt | Without proof, you CANNOT file a complaint. |
| Read labels carefully | MRP, expiry date, ingredients, manufacturer info. |
| Do NOT fall for misleading ads | '50% off' — compare prices. 'Guaranteed' — ask for written terms. |
| Speak up against unfair trade practices | If you stay silent, the PRACTICE continues. |
| File complaints when WRONGED | Your case HELPS others. Consumer courts exist to PROTECT you. |
