A composition taxpayer pays tax at a flat percentage of turnover to the government but is specifically barred from charging that tax separately to the recipient, since the composition scheme's whole simplification is that the flat rate is borne by the supplier out of the price received rather than collected as an additional, separately identified amount from the buyer in the way ordinary GST is. The e-way bill is treated as a distinct requirement from the tax invoice, rather than the invoice alone being considered sufficient evidence of a lawful movement, because an invoice can in principle be generated without any actual corresponding movement of goods ever taking place, or a movement can occur without a genuine underlying supply being properly recorded; a paper or digital invoice sitting in a company's records proves nothing about what is physically on a truck at a given moment on a given road. The e-way bill closes this specific gap by creating a document that is generated in real time, tied to the specific movement, and required to be physically present and verifiable at the point of transit itself, giving enforcement authorities a live, checkable record of goods actually in motion that complements, rather than duplicates, the invoice and return system's after-the-fact documentation of supplies and liabilities.

Question 5

A registered person owes ₹50,000 in output tax, ₹5,000 in interest for a delayed earlier payment, and a ₹2,000 late fee for a delayed return. His electronic credit ledger holds ₹40,000 of eligible credit. Advise on which liabilities can be discharged from the credit ledger and which must be paid from the cash ledger.

The electronic credit ledger reflects eligible input tax credit availed by the registered person and is debited when that credit is utilised, but its use is expressly confined to discharging output tax liability; it cannot be used to pay interest, penalty, fee or any other liability, all of which must be paid from the cash ledger, which reflects actual cash deposits made by the taxpayer through prescribed payment modes. Applying this to the figures given: the 40,000 of available credit can be applied against the 50,000 output tax liability, reducing the tax payable in cash to 10,000, that is 50,000 less the 40,000 credit utilised. The 5,000 interest and the 2,000 late fee, totalling 7,000, cannot be touched by the credit ledger at all and must be paid in cash regardless of how much unused credit, if any, remains; here the credit has been fully exhausted against tax in any event, so the full 7,000 of interest and late fee, plus the residual 10,000 of tax not covered by credit, giving a total cash payment of 17,000, must be deposited into and paid from the cash ledger. The distinction exists because interest, penalty and fees are consequences of default rather than tax on value added, and allowing input credit, which represents tax genuinely paid on business inputs, to satisfy penal or compensatory charges would blunt the deterrent and compensatory purposes those charges are meant to serve.

Question 6

State the due dates for GSTR-1 and GSTR-3B for a monthly filer, explain what each return actually does, and state why a taxpayer cannot simply file GSTR-3B alone and skip GSTR-1.

A taxpayer pays output tax of ₹2,00,000 fifteen days after the due date. Separately, it is found that the same taxpayer wrongly availed and utilised input tax credit of ₹1,50,000 to which it was never entitled, discovered and reversed forty-five days after the credit was wrongly utilised. Compute the interest position in principle for each, stating the applicable rate.

On the first item, the 2,00,000 of output tax paid 15 days after its due date, interest accrues at 18 per cent per annum on 2,00,000 for the 15-day delay period, which in principle would be computed as 2,00,000 multiplied by 18 per cent, annualised down to a daily rate, multiplied by 15 days, giving an interest figure for that short delay period at the ordinary rate. On the second item, a distinct and deliberately higher rate of 24 per cent per annum applies specifically where the default is input tax credit wrongly availed and utilised, rather than an ordinary payment delay; this higher rate reflects that wrongly availing and actually utilising credit the taxpayer was never entitled to is treated as a materially more serious default than simply being late with a genuine, otherwise-correct tax payment, since it involves the taxpayer having effectively reduced its output liability using a credit that should never have existed at all, closer in character to an underpayment through improper means than to mere administrative delay. Interest on the 1,50,000 of wrongly availed and utilised credit accrues at 24 per cent per annum for the 45 days it remained utilised before being reversed, a materially higher effective cost per day than the first item's 18 per cent rate would produce on a comparable amount, illustrating the deliberately punitive gap between the two rates.

State the return filing obligations of a composition taxpayer, contrasting them with the regular scheme's cycle, and explain why the composition scheme's compliance burden is lighter.

This is a materially lighter compliance burden in both frequency, quarterly payment rather than monthly filing and payment, and in detail, since a composition taxpayer's flat-rate liability computed on turnover does not require the invoice-level outward supply disclosure that GSTR-1 demands of a regular taxpayer, nor the detailed input tax credit reconciliation that GSTR-3B involves, because a composition taxpayer cannot claim input tax credit at all and so has no credit-side computation to report or reconcile in the first place. The underlying reason the scheme's compliance burden is deliberately kept light is consistent with the scheme's whole purpose: composition is aimed at small taxpayers for whom the ordinary GST compliance apparatus, invoice-level reporting, monthly filing, detailed credit reconciliation, would represent a disproportionate administrative cost relative to the size of their business and the modest tax revenue at stake, so the trade-off offered is a simple flat rate on turnover, no ability to claim credit or to charge tax separately to customers, in exchange for a much simpler, quarterly-and-annual filing rhythm that a small trader can realistically manage without extensive accounting support.

A registered person's registration is cancelled with effect from 1 June. State the obligation that follows regarding a final return, and explain why this differs from an ordinary periodic return.

A person whose registration is cancelled must furnish a final return within a prescribed period from the date of cancellation or the date of the cancellation order, whichever is later, and this final return specifically requires reporting of closing stock held as of the effective date of cancellation and computation of any tax payable in respect of that closing stock. This obligation exists and operates differently from an ordinary periodic return, such as a monthly GSTR-3B, in a specific and important respect: an ordinary periodic return reports transactions and liability arising from ongoing outward supplies made during the period, whereas the final return additionally requires the taxpayer to account for input tax credit previously claimed on goods that remain unsold, in the form of closing stock, as at the point the registration ceases. The reasoning is that input tax credit is meant to flow through to an eventual taxable outward supply; where a registration is cancelled while stock on which credit was earlier claimed remains unsold and undisposed of, that stock will now never generate the outward taxable supply the original credit anticipated, at least not under this registration, so the final return is the mechanism by which any credit attributable to that residual, unsupplied stock is reversed or accounted for as tax payable, closing out the taxpayer's position cleanly rather than leaving an unresolved credit claim attached to a registration that no longer exists. This is conceptually related to the section 17(5) treatment of goods otherwise lost or disposed of without a corresponding taxable supply, extended here to the specific circumstance of registration cancellation itself.

Question 10

A supplier discovers that an earlier invoice undercharged the buyer because the taxable value was understated due to a clerical error. State the document the supplier should issue, and its effect.

The supplier should issue a debit note. A debit note is issued by the supplier where the taxable value or tax charged in the original invoice is found to be less than what should actually have been charged, which is exactly the situation described: a clerical error understated the taxable value, meaning both the value and the corresponding tax charged on the original invoice were too low. The debit note formally records and communicates the additional taxable value and the additional tax now due, increasing the recipient's payment obligation and correspondingly increasing the supplier's output tax liability for the period in which the debit note is issued and declared. Its effect operates in the opposite direction to a credit note: rather than reducing the supplier's liability and requiring a corresponding recipient credit reversal, a debit note increases the supplier's declared output liability, and the recipient, upon receiving it, would generally be entitled to avail additional input tax credit corresponding to the additional tax now properly charged, provided the recipient otherwise satisfies the ordinary section 16(2) conditions for claiming that further credit. Unlike a credit note, a debit note does not carry the same deadline-and-non-availed-credit conditions, since increasing tax properly due does not raise the same revenue-protection concern that reducing previously charged and already-credited tax does.

Question 11

A trader moves goods worth ₹42,000 by his own vehicle within the same city for delivery to a customer. Separately, he moves goods worth ₹65,000 to a customer in another state. Advise on the e-way bill requirement for each, and state the general principle behind the consignment value threshold.

The second movement, goods worth 65,000 moved to a customer in another state, exceeds the 50,000 threshold and accordingly requires an e-way bill to accompany the movement, generated on the common portal with the prescribed details of the goods, the consignor, the consignee and the transporter, before the movement of goods commences. The general principle behind the consignment value threshold is proportionality in compliance burden: requiring an e-way bill for every movement of goods regardless of value, down to the smallest local delivery, would impose a substantial administrative burden on low-value, routine commercial activity for comparatively little enforcement benefit, since the revenue at stake on very small consignments is itself modest; setting a reasonable value threshold concentrates the e-way bill requirement, and the corresponding enforcement and verification effort it enables, on movements of goods substantial enough that verifying their genuine correspondence to a properly documented and taxed supply is worth the compliance cost involved for both the taxpayer and the tax administration.

The relationship between the three is sequential and reflects the actual mechanics of monthly compliance: when a registered person files a return such as GSTR-3B, the return computation determines the total tax liability for the period, and this liability is recorded in the Electronic Liability Register as an amount owed. The taxpayer then discharges that liability by drawing first, to the extent eligible, on the Electronic Credit Ledger, which reflects input tax credit the taxpayer has validly availed and which can be used to pay tax, applied according to the mandated order of utilisation between IGST, CGST and SGST/UTGST components; any portion of the liability that credit cannot cover, together with any interest, penalty, fee or other non-tax liability recorded in the register, must then be paid from the Electronic Cash Ledger, which reflects actual cash deposits the taxpayer has made through prescribed payment modes such as internet banking, over-the-counter payment, or other notified methods. Late fee accrues at a prescribed daily rate, subject to a maximum cap, purely for the delay in filing the return itself, as a document, regardless of whether any tax was actually due for that period; it is, in substance, a charge for the administrative default of not submitting the required filing on time. Interest, by contrast, accrues specifically on tax that remains unpaid past its due date, computed as a percentage per annum on the outstanding tax amount for the period of the delay; it compensates the government for being kept out of money that was genuinely due and unpaid, and it has no application at all where no tax was actually owed for the period, however late the return itself was filed. A taxpayer who files a return ten days late, and who owed tax for that period, would typically face both a late fee for the ten-day filing delay and interest on the tax that remained unpaid during those same ten days, the two charges running in parallel and addressing the filing default and the payment default respectively. Late fee is generally set at a lower rate, or a lower daily cap, for a taxpayer with nil liability for the period, because a nil-liability filer's delay causes no revenue loss to the government at all, there being no tax outstanding during the delay, so the late fee in that case is purely an administrative-compliance charge unconnected to any actual financial harm, and is calibrated accordingly to be less severe than the fee attaching to a delayed filing where genuine tax revenue was also sitting unpaid.
