Opposition parties functioned as **parties of pressure** rather than as alternative governments. Lacking a realistic prospect of power, they operated by influencing Congress factions sympathetic to their positions, and by holding ideological ground that the Congress would eventually occupy. Their function was to press the dominant party rather than to replace it.

**Why the system was stable.** It combined the **legitimacy of competition** with the **stability of dominance**: dissent had institutional channels, so it did not accumulate outside the system; and the Congress's ability to absorb new demands meant that groups entering political life were incorporated rather than excluded.

**The three channels, and which has changed.**

**Kothari's** formulation must be stated accurately because it is routinely inverted: it is **not that caste entered politics but that politics transformed caste**. **The mechanism.** Universal adult franchise, granted at independence to a largely non-literate population, made **numbers a political resource**. A politician seeking votes needed a unit capable of aggregating a large constituency, and caste supplied one that already existed, with recognised leadership, internal communication and existing solidarity. Caste became the vehicle of mobilisation not because politicians were traditional but because it was the most efficient available instrument — a thoroughly modern calculation.

**What this did to caste.** The transformation ran both ways. Caste acquired **modern organisational forms**: the **caste associations** analysed by **Rudolph and Rudolph** developed formal membership, office-bearers, publications, hostels and scholarship funds, and pressed organised demands on the state. It acquired a **wider scale**, since electoral arithmetic required aggregating local jatis into larger blocs that had no prior existence as units — which is how broad administrative categories became socially and politically real. And it shifted from a **ritual to a secular register**: the demands are for representation, employment and educational access, not for ritual precedence.

**The case that it strengthened democracy.**

It **deepened participation**. Groups with no other organisational resource entered political life through the one form of solidarity available to them, and turnout in India has characteristically been higher among the poorer and lower-caste sections than among the affluent — an inversion of the pattern in most democracies and a direct consequence of caste mobilisation.

It produced **leadership from previously excluded strata**. The social composition of legislatures and of state political leadership has changed substantially, and the change tracks the mobilisation.

The alternative to caste-based mobilisation in the Indian context was not class-based or programmatic mobilisation, which had no organisational base; it was the continuation of a politics dominated by the already-organised upper strata. *Claim:* nationalism was the product of the **material conditions created by colonial rule**, not the expression of a pre-existing national consciousness. Colonial rule introduced a new economic structure — commercialised agriculture, new land tenures, modern industry, railways, a national market — which created new classes: an industrial bourgeoisie, a working class, landed intermediaries and a Western-educated middle class.

*Mechanism:* nationalism was the **ideology of these new classes**, and its phases correspond to the successive entry of different classes into the movement, which explains why its programme shifted over time from moderate constitutional demands to mass mobilisation.

*Verdict:* the leadership was bourgeois, and the movement's social conservatism — its reluctance to press agrarian and labour demands that threatened propertied supporters — served that class's interests. Independence transferred power to an indigenous propertied class.

**The subaltern perspective**, following **Ranajit Guha**.

*Claim:* both the nationalist and the Marxist historiographies are **elitist**. The nationalist account attributes the movement to nationalist leadership; the Marxist account attributes it to a bourgeoisie. Both locate agency at the top and treat the mass of participants as mobilised, led or manipulated.

*Mechanism:* there existed an **autonomous domain of subaltern politics**, not derived from elite mobilisation and operating by its own logic. Peasant insurgency had its own forms, its own consciousness and its own objectives, and it was neither pre-political nor spontaneous, as both other accounts imply.

*Verdict:* the Indian bourgeoisie **failed to achieve hegemony** — it dominated without leading, so the resulting order was one of **dominance without hegemony**, in which the ruling group commands without having secured genuine consent. The **failure of the nation to come into its own** is Guha's formulation of what the historiography must explain.

**The points of disagreement.**

On **agency**: classes formed by colonial economic transformation, against subaltern groups acting on their own initiative.

On **consciousness**: the Marxist account treats subaltern participation as mobilised by elite leadership and constrained by false consciousness; the subaltern account insists on an autonomous consciousness with its own rationality.

On **method**: Desai works from political economy and the structural analysis of class formation; Guha and his colleagues work from the close reading of archives **against the grain**, recovering subaltern voices from records compiled by their opponents.

On **the explanandum**: Desai explains why nationalism took the form it did; Guha explains why it failed to become hegemonic.

**Where they converge.** Both deny that the movement was a unified national awakening; both identify the leadership as socially narrow; both regard independence as leaving social structures substantially intact; and both treat the Congress's social conservatism as significant rather than incidental.

**Critiques of each.** Desai's class reductionism struggles to account for the autonomy of caste, religion and region as bases of mobilisation, and for the fact that caste has proved more effective than class as an organising category in Indian politics. Guha's approach has been criticised for romanticising subaltern autonomy, for the methodological difficulty of recovering consciousness from hostile sources, and — by later scholars within the project itself — for treating the subaltern as a unified category when it is internally stratified by caste and gender.

**Assessment.** The subaltern critique of the Marxist account is largely successful on its own terms: Desai's framework does locate agency with classes formed from above and does treat mass participation as mobilised. But the Marxist account explains something subaltern historiography does not — the **specific content** of the movement's programme and its shifts over time, which the class composition of its leadership predicts well. The two are best read as answering different questions, and the **Dalit** perspective is the necessary third term, since it asks who benefited from independence in a way neither fully addresses — Ambedkar's point that for the untouchables the oppression was domestic rather than colonial cuts across both class and subaltern framings.

Question 12

Examine the debate on judicial activism and judicial overreach in India.

Accepted Answer

The debate turns on a distinction that both sides accept in principle and apply differently: **activism** is the vigorous exercise of a court's own function, **overreach** is the exercise of another institution's.

**How the expansion occurred.** Three developments together.

**Public interest litigation** relaxed the requirement of standing, permitting any public-spirited person to move the court on behalf of those unable to approach it, and allowing proceedings to be initiated on letters and communications rather than formal petitions. This converted the court from a forum for parties into a forum for grievances.

**Expansive interpretation** of the right to life and personal liberty read into it a range of substantive entitlements — to livelihood, shelter, health, education, a clean environment, and dignity — which converted non-justiciable directive principles into enforceable claims by interpretive route.

**Continuing mandamus** allowed the court to retain a case and issue successive directions monitoring implementation over years, which is an administrative rather than an adjudicative function.

**The case for.**

The court acted where **other institutions failed**. Where a legislature does not legislate and an executive does not enforce, a court that declines to act is not neutral but ratifies the failure.

Access to justice for those **unable to approach the court** — prisoners, bonded labourers, undertrials — required relaxing procedural requirements designed for parties with resources.

Directive principles were declared **fundamental to governance**, and the argument that they should inform the interpretation of rights is textually grounded rather than invented.

And on the record, judicial intervention produced outcomes — on environmental protection, on custodial safeguards, on transparency — that the political process had not.

**The case against.**

**Institutional competence.** Courts are equipped to adjudicate disputes on evidence and argument, not to design policy, allocate resources or manage implementation. A court directing how a programme should operate is deciding questions it lacks the information and expertise to decide.

**Accountability.** A legislature that decides badly can be removed; a court cannot. Judicial policy-making transfers decisions from an accountable body to an unaccountable one, which is the **counter-majoritarian difficulty** applied to policy rather than to rights.

**Selectivity.** The court decides which causes to take up, and the choice is not governed by any principle — which means judicial priorities substitute for political ones without the discipline of an electorate.

**Displacement.** Where the court reliably intervenes, the political process has less incentive to act, so judicial activism may weaken the institutions whose failure justified it.

**Enforcement.** Directions requiring sustained administrative action are frequently not implemented, which produces the worst outcome — the appearance of remedy without the substance, and a decline in the court's own authority.

**The appointments question** is connected and is where the debate becomes concrete. A judiciary exercising expanded power raises the question of who selects it. The **collegium** system was itself a product of judicial interpretation, and the argument about it reproduces the larger debate: judicial control of appointments protects independence and lacks transparency and accountability; executive control provides accountability and threatens independence. The **appointment control matters more than removal protection** principle applies directly.

**Assessment.** The distinction between activism and overreach is real but has no bright line, and each side applies it to the cases it dislikes. The more defensible position specifies a **functional test**: intervention is justified where a **right** is at stake and an institution has defaulted, and is not justified where the question is one of **policy choice among reasonable alternatives**. On that test, directing that undertrials be released after serving the maximum sentence is adjudication; directing which technology a city should adopt is not. The test does not resolve every case and it identifies what the argument is actually about, which is more than the activism-overreach labels achieve.

Comment on why the independence of the Election Commission depends more on appointment than on removal. (150 words)

Accepted Answer

The general principle is that **appointment control matters more than removal protection**, and the Election Commission is the clearest case.

**Removal protection** is strong: the Chief Election Commissioner can be removed only in the manner and on the grounds applicable to a Supreme Court judge, which requires a parliamentary process with special majorities. In practice this makes removal virtually unavailable.

**Appointment** determines independence nonetheless, for a simple reason: a body's conduct is shaped by who is selected, not by whether they can subsequently be dismissed. If the executive controls selection, it need never contemplate removal — the disposition it wants is present from the outset. Security of tenure then protects an appointee whose selection already reflected the appointing authority's preferences.

The secondary mechanism is **post-retirement expectation**: where future appointments are in the executive's gift, an incumbent's conduct can be influenced without any threat to tenure.

This is why the composition of the selection body is the substantive question in every debate about the Commission's independence, and why removal safeguards, however strong, do not settle it.

Examine the role of social movements in deepening Indian democracy.

Social movements in India have performed functions that the party system has not, and the analytical claim worth defending is that they constitute a **second channel** of democratic action rather than a supplement to the first.

**Why a second channel was needed.** The party system aggregates interests that are numerically large and geographically concentrated, because those are what win seats. Interests that are diffuse — environmental quality, transparency, civil liberties — or that belong to groups too dispersed or too small to be electorally decisive have no route through parties. Movements supply one.

**What they have achieved.**

The **right to information** movement is the clearest case: a demand originating in local struggles over wage records in rural Rajasthan, generalised into a national campaign, and converted into legislation that altered the relationship between citizen and administration. No party proposed it; the movement created the demand and the political cost of resisting it.

The **employment guarantee** campaign followed a comparable path from mobilisation to statute. The **forest rights** legislation responded to sustained mobilisation by forest-dwelling communities. **Civil liberties** organisations, arising substantially in response to detention without trial and custodial violence, created a domain of scrutiny that neither parties nor the press had occupied.

**Environmental movements** are analytically the most instructive. **Guha and Gadgil's** distinction between the environmentalism of the affluent and the **environmentalism of the poor** identifies what makes the Indian case distinctive: movements over forest access, displacement by dams and mining, and mechanised competition in fisheries were **livelihood** movements of the materially insecure, not post-material movements of the comfortable. This defeats the causal claim of Western new-social-movement theory, which holds that such movements arise once material security is assured — and it establishes that the environment can be a class question, which the post-material framing forecloses by definition.

The **women's movement's** autonomous phase raised issues — violence within the family, custodial violence, dowry, property rights — that no party had taken up, and secured legislation on several.

**How they deepen democracy.**

They **expand the agenda** beyond what electoral competition generates, which addresses the second face of power directly — issues that would otherwise never reach a decision.

They **create political capacity** among participants, which is the developmental argument for participation in its Indian form.

They **operate between elections**, supplying accountability in the interval where the electoral mechanism is dormant.

And they have **worked through constitutional channels** — litigation, legislation, campaigns — rather than outside them, which is not trivial in a society with the inequalities India has.

**The limitations.**

**Accountability**: a movement speaks for a constituency that has not elected it, and its internal decision-making is frequently opaque.

**Representativeness**: leadership is often drawn from a narrow social stratum, and the Dalit feminist critique of the women's movement is the standard instance of a movement's agenda reflecting its leadership rather than its constituency.

**Durability**: movements depend on sustained mobilisation and dissipate when it lapses, so gains institutionalised in law survive while those resting on pressure do not.

**Capture and professionalisation**: movements that acquire funding and formal organisation may shift from mobilisation toward service delivery and advocacy, which changes what they can do.

**Assessment.** The Indian record supports the claim that movements have deepened democracy substantially, and the strongest evidence is legislative: several of the most consequential statutes of the past three decades originated in mobilisation rather than in party programmes. The qualification is that this route works where a demand can be **converted into a legal entitlement**; where the required change is distributional and continuous rather than legislative, movements have achieved far less — which is why the environment and livelihood movements have secured recognition of rights more successfully than they have secured the enforcement of them.

Assess the working of the Indian Constitution against the framers' expectations.

Accepted Answer

The assessment should be organised around what the framers were trying to achieve, which **Granville Austin** identified as a **seamless web** of three commitments — national unity and integrity, democratic institutions, and social revolution — held together by **accommodation**, the technique of adopting apparently incompatible objectives and leaving their reconciliation to practice.

**National unity: substantially achieved, by an unexpected mechanism.**

The expectation was that a strong centre would be required to hold a diverse society together, which is why residuary power, emergency provisions, All-India Services and a centrally appointed Governor were adopted, and why the Gandhian village-republic scheme was defeated.

The outcome vindicated the concern and not the instrument. Unity has held, but the mechanism that produced it was **accommodation of regional identity** rather than central authority. Linguistic reorganisation, initially resisted as fissiparous, converted an existential demand for recognition into ordinary distributive politics conducted within the federation. The federal structure absorbed regional assertion by giving it institutional expression. Meanwhile the most centralising instrument, the constitutional breakdown provision, was progressively constrained by judicial standards — and unity was not thereby weakened.

**Democratic institutions: achieved in survival, weakened in quality.**

The expectation, doubted by many contemporary observers, was that parliamentary democracy could operate in a poor, largely non-literate and deeply unequal society. It has: elections have been held regularly, power has transferred peacefully between parties and coalitions, and participation has been high and has been higher among poorer and lower-caste voters than among the affluent — an inversion of the pattern in most democracies.

The **quality** of institutional functioning is a different verdict. Parliamentary sittings have declined, committee referral of bills has fallen sharply, financial scrutiny is substantially formal, and anti-defection provisions have converted legislators into party delegates. The framers assumed that a legislature would scrutinise an executive; they did not anticipate how thoroughly party discipline in a majority system would neutralise that function.

**Social revolution: the weakest of the three.**

This is where the accommodation technique produced the least. **Directive principles** were declared fundamental to governance and made non-justiciable — a compromise that acknowledged the goals while withholding the means, and their subsequent enforcement came through **judicial interpretation** of the right to life rather than through legislative action, which was not the mechanism envisaged.

**Untouchability** was abolished and stigma-based exclusion and violence have proved the most resistant element of the caste order — which is what **Ambedkar** predicted and what a purely legal remedy could not have prevented. **Land reform** succeeded in abolishing intermediaries and largely failed on tenancy and ceilings, so its consequence was a new dominant agrarian class rather than redistribution. **Substantive equality** provisions have produced a mobile stratum within disadvantaged groups without dissolving the structures that produced the disadvantage.

**The framers' own warning.** Ambedkar's closing speech to the Assembly stated the problem precisely: India was entering a life of contradictions, with **political democracy** — one person, one vote, one value — resting on a social and economic structure denying equality; and a contradiction of that kind, he warned, must be resolved or those denied will blow up the structure of political democracy. That is the standard against which the social revolution should be assessed, and it was set by the framers themselves.

**What was not anticipated.**

The **judiciary's** expansion — public interest litigation, the substantive reading of the right to life, and the basic structure doctrine — gave courts a role no one in the Assembly proposed.

The **transformation of caste** into a political resource was not foreseen: the expectation was that caste would weaken with modernisation, not that universal franchise would make it the principal instrument of mobilisation.

And the **variation across states** under an identical constitutional framework is the most striking unanticipated finding, since it demonstrates that constitutional design underdetermines outcomes and that political and social factors do most of the explanatory work.

**Assessment.** The Constitution succeeded most where it created **enforceable institutional obligations** — elections, courts, the federal structure — and least where it stated **objectives without enforcement**, which is directive principles and much of the social revolution. That pattern is not a coincidence but the accommodation technique's predictable outcome: what was made justiciable was delivered, and what was left to political good faith was delivered only where political forces independently demanded it.
